These Terms of Service govern your use of the Greycrest Visuals Inc. website located at greycrestvisuals.com and your engagement of our video production and photography services. By accessing our website or engaging our services, you agree to these terms.

1. About Greycrest Visuals Inc.

Greycrest Visuals Inc. is a video production and photography company incorporated in British Columbia, Canada. We produce brand story films, testimonial videos, explainer videos, promotional video, event videography, documentary films, commercial video, and corporate photography for institutional, government, nonprofit, and enterprise clients across Canada.

2. Website Use

You may use this website for lawful purposes only. You agree not to:

  • Use the website in any way that violates applicable local, provincial, national, or international law or regulation
  • Transmit any unsolicited or unauthorized advertising or promotional material
  • Attempt to gain unauthorized access to any part of the website or its related systems
  • Use the website to transmit any harmful, offensive, or disruptive content
  • Copy, reproduce, or distribute content from this website without our written permission

3. Intellectual Property

4. Production Services and Agreements

Engagement of Greycrest Visuals Inc. for production services is governed by a separate written production agreement or statement of work, which will specify the scope of services, deliverables, timeline, payment terms, revision rounds, and licensing terms applicable to that engagement.

These Terms of Service apply to your use of this website and are supplemental to, not a replacement for, any production agreement you enter into with us.

5. Payment Terms

Payment terms for production services are established in the applicable production agreement or invoice. Standard terms require a deposit prior to commencement of pre-production, with the balance due upon delivery of final files unless otherwise agreed in writing.

Invoices not paid within the agreed payment period may be subject to a late payment fee of 1.5% per month on the outstanding balance.

6. Ownership of Deliverables and Licensing

Upon receipt of full payment, Greycrest Visuals Inc. grants the client a license to use the deliverables as specified in the production agreement. Unless otherwise agreed in writing, Greycrest Visuals Inc. retains ownership of the original footage, raw files, and project files.

Greycrest Visuals Inc. retains the right to use completed productions in our portfolio, on our website, in marketing materials, and in award submissions, unless the client has requested confidentiality in writing prior to commencement of the project.

7. Revisions and Scope Changes

The number of revision rounds included in a production is specified in the production agreement. Revision requests that exceed the agreed rounds, or that constitute changes to the approved scope or direction, may be subject to additional fees.

Scope changes requested after production has commenced will be assessed and quoted separately. We will not proceed with scope changes without written authorization.

8. Client Responsibilities

The client is responsible for:

  • Providing accurate and complete information at the brief stage
  • Securing necessary permissions, releases, and access for filming locations and participants
  • Reviewing and approving deliverables within the timeframes established in the production agreement
  • Ensuring that any materials provided to Greycrest Visuals Inc. for use in the production do not infringe the intellectual property rights of any third party

9. Limitation of Liability

To the maximum extent permitted by applicable law, Greycrest Visuals Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or our services, including but not limited to loss of revenue, loss of data, or loss of business opportunity.

Our total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific production giving rise to the claim.

10. Force Majeure

Greycrest Visuals Inc. shall not be liable for delays or failure to perform services resulting from circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, public health emergencies, government orders, or acts of God. We will notify the client as soon as practicable and work to reschedule or mitigate the impact.

11. Governing Law

These Terms of Service are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of British Columbia.

12. Changes to These Terms

We may update these Terms of Service from time to time. The effective date at the top of this page will be updated when changes are made. Your continued use of this website following any changes constitutes your acceptance of the updated terms.
